A Revocable Living Trust is an agreement regarding the passing of property from one to another. A trust is revocable when it can be revoked, or terminated, by the person creating the trust (sometimes referred to as a “Settlor”). A trust is “living” in that it can also be amended by the creator(s) of the trust during their lifetimes. The Settlor is the current owner of the estate or assets for tax purposes. The Settlor is most often also the Trustee initially, and their job is to manage the assets that the Settlors place into the trust. A Beneficiary is a recipient who will at some point inherit the property or assets. All of these people, Settlors, Trustees, and Beneficiaries, are named by the Settlors in the trust document. GeauxPlans’ Revocable Living Trust will allow your beneficiaries to receive their inheritance outright, without going through the time and expense of court proceedings.

A Power of Attorney is a legal document that allows you to appoint someone that you know and trust to make financial and medical decisions for you.  Financial decisions typically related to your property or assets, and may include the power to access accounts, pay expenses, buy, sell, exchange, enter into legally binding contracts, create trusts, make donations, etc. Medical decisions typically related to your “person” and may include the power to consent to medical procedures, access protected health information, and to make arrangements for your care.

A Durable Power of Attorney just means that the Power of Attorney remains effective after the principal (i.e., the person granting the Power of Attorney) becomes incapacitated. If a Power of Attorney is not durable, it terminates when the principal loses capacity, which could defeat the purpose of the Power of Attorney – to ensure someone can make decisions for the principal in the event of incapacity.

It should take about 20 minutes to complete your Trust-Based Estate Plan through GeauxPlans.

While signing requirements vary from state to state, we recommend that Powers of Attorney be signed in the presence of a notary and two witnesses. Failure to do so may render your documents legally invalid.
